Terms & Conditions


1)The Carrier agrees to transport the property described here on subject to the terms and conditions prescribed by this Bill of Lading and by the proper authority of the province in which this shipment originates and the rules and regulations published in the Carriers Tariff in effect of the date hereof. Under no circumstances shall the Carrier be bound by any other conditions whether written or verbal, irrespective of the source of such conditions, however implied by the Shipper, Consignee, Carriers employees or agents or any other party. The terms and conditions apply equally to the Shipper and Consignee.

2)Limitation of Liability: The Carriers liability in respect of any one shipment shall not exceed $1000.00 or $2.00 per lb. ($4.40 per: kg.) whichever is less. If no value is declared on the face hereof or if a shipment has a declared value in excess of $500.00 and no prior special agreement in writing has been obtained, this shall be deemed to be an agreement that the value of the goods shipped is $2.00 per pound ($4.40 per kg.) and the Carrier shall not be liable for any damages in excess thereof. Under no circumstances shall the Carrier be liable for any incidental , loss of use, consequential or any other damage or monetary loss as a result of delayed delivery or lost or damaged shipment and/or any negligence on the part of its employees, servants, agents or connecting carriers. No liability shall be accepted for any commodity which is shipped in containers that are not sufficiently insulated from damage due to handling or freezing, No coverage for glass. Tenders/Financial Documents: The Shipper and/or Consignee hereby agree to absolve the Carrier of any and all financial loss with respect to such shipment however caused.

3)Dangerous Goods: The Carrier shall not be liable for damage, loss, or failure to deliver goods that are prohibited, restricted or required to be carried in special or protective containers as prescribed by the proper authority in the province of Federal jurisdiction. The Shipper agrees to indemnify Carrier of all costs and damages whatsoever caused by its failure to disclose and/or properly contained dangerous goods.

4)Shipping Charges: The Shipper guarantees to pay for any and all shipping charges including “Collect Shipment” costs which are not honored for whatever reason by the Consignee.

5)The Carrier reserves the right to refuse the handling of any shipment. The Carrier also reserves the right to use whatever mode of transport it sees fir due to the nature of the shipment or when required to comply with regulatory agencies.

6)Claims: No claims shall be accepted after 30 days of Bill of Lading date. No claim will be entertained until all transportation and insurance charges thereon have been paid.

7)Extra Insurance: The Shipper may insure any one shipment up to a maximum of $1000.00 if the valuation of $2.00 per lb. (4.00 per kg.) Is the lesser, providing that such request be indicated on the Bill of Lading at the time of pick-up and the Shipper agrees at the time to pay for additional insurance. No insurance will be provided for glass or glass product shipments. To wit, the Shipper assents and as evidence thereof accepts this receipt and acknowledges that the Carrier does not guarantee delivery times.
